JLJ Auto Recovery, Inc. is a bonded repossession company that has been in
business since 1993. We pride ourselves on our professional and efficient
results.
Our policy is to never take a risk in recovering a unit that might result in
damaging the collateral or any property or result in injury to any person. Our
policy is also to avoid any illegal action, such as breach of peace, wrongful
repossession, breaking and entering, etc.
The use of drugs is prohibited. The use of alcohol during or prior to working
is prohibited. Firearms in or out of the office are prohibited. All traffic laws
governing repossession are to be followed at all times.
The field agent's primary responsibility is to go to his destination and
attempt to recover the said collateral. It is his responsibility to document a
situation at the time it occurs. Once the collateral is recovered, he is to
report self-help or a voluntary repossession to the proper law enforcement
agency. The field agent is then to bring collateral to storage yard and secure
all personal items. Condition reports and personal property inventory reports
are to be done at this time. The field agent accepts no payment or arrangements
for payment without the consent of the client.
The secretary handles the daily paperwork, including billing, faxing
condition reports, etc.
A self-help repossession, which is allowed in Colorado as long as the peace
is not broken, is the taking of the debtor's collateral without their knowledge
or consent. Breach of peace occurs when at any time during the recovery of any
collateral there is an attempt by the debtor or any third party to physically
stop an agent or any physical contact with debtor or third party attempts to
stop the repossession by preventing the agent from leaving, all local laws are
obeyed. At no time will the agent engage in verbal or physical confrontation
with the debtor or third party.
The following are the steps to follow for the self-help repossession:
- The agent will identify the unit by checking the VIN and unit description.
- The agent will be sure that he knows the proper towing procedure for the
collateral.
- The agent will notify law enforcement of the repossession as soon as the
vehicle is secure and away.

The following are the steps to follow when the debtor or third party
becomes aware of the self-help repossession:
- The agent should calmly continue to hook the collateral, being careful not
to allow the debtor to block him in.
- As he does this, he should identify himself and the bank or client that
has authorized the repossession.
- The agent should not argue with the debtor, but offer information on who
they can contact regarding their loan and the repossession. The agent may
offer a card from JLJ in case they would like to speak to someone in the
office about the repossession or any other concerns. If the agent feels
comfortable in letting the debtor remove personal property from the vehicle at
this time, he may do so if the debtor would like to surrender the keys.
- The agent should attempt to leave the area as soon as possible and report
the repossession to local authorities.
- If for some reason the agent cannot secure the collateral, he should try
to talk to the debtor and convince him to surrender the unit. If the debtor
will not surrender the unit the agent will try to get the client on the phone
to talk to the debtor. If not during business hours, agent will provide debtor
with the phone number and name of the collector to contact regarading the past
due account.
